The Alexandra Magistrates Court yesterday granted bail to three of the four suspects charged with the murder of Julius Friday Chukwunta, a Nigerian citizen. Representing the Nigerian Union South Africa (NUSA), Legal Adviser 2, Attorney Elsie Ogounga, led efforts to oppose the bail applications in the highly contentious case.
The accused face murder charges under the Criminal Procedure Act’s Schedule 5, which categorizes serious offences. During the hearing, the first accused’s lawyer argued that the incident stemmed from a parking dispute that escalated into a physical confrontation. The second accused denied involvement, while the third accused claimed he acted to protect the first accused. Bail for the fourth accused was postponed due to the recent appointment of a Legal Aid attorney.
Despite resistance from Attorney Ogounga and the prosecution, Regional Magistrate Boshoff approved bail for the first three accused, setting it at R10,000 each under stringent conditions. The court’s decision followed detailed arguments presented by both sides, weighing the defendants’ constitutional rights and the severity of the charges.
The hearing attracted widespread attention, with several Nigerian community leaders present, including Mr. Joe Ani, Chairman of the Nnewe Development Union South Africa, and Sir Jonas Udeji, a prominent Igbo leader. Ani commended NUSA’s legal team, praising Attorney Ogounga for her efforts and recognizing NUSA President General Prince Barr. Smart Nwobi for his leadership.
NUSA also issued a statement condemning disruptive factions at the courthouse, calling for calm to allow the judicial process to continue without interference.
The case has been adjourned to February 3, 2024, for further investigation.
